Erath County Court Record Requests
Match your request to the court that owns the case. The Erath District Clerk holds the 266th District Court's civil, criminal, and family records. Those include pleadings, instruments, and papers. County, probate, and Justice Court materials sit with the Erath County Clerk. They are split across separate divisions. Stephenville and Dublin keep their municipal files at the city courts. Federal matters arising in Erath belong to the Northern District of Texas.
The Erath Online Services hub links Court Records & eDiscovery. re:SearchTX adds a statewide layer. No image online? Call or visit the correct clerk. Ask whether mail, email, pickup, or another delivery channel works for that request. A Texas Public Information Act form can reach county administrative records. It cannot replace an Erath court-copy order.
- Record the cause number, case style, court, and document name.
- Check the Erath portal or re:SearchTX for the register and public images.
- Select the Erath District Clerk, County Clerk division, JP, or municipal clerk.
- Request a plain, certified, or appeal copy and obtain the current total.
- Confirm payment and delivery terms directly with the Erath custodian.
Three Erath Court Record Products
An Erath docket, a filed paper, and a certified copy answer three different questions. The docket itself is a running list. It tracks filings, settings, and rulings in one place. The filed paper is the actual document behind an entry, whether that is a petition, motion, order, judgment, citation, return, or exhibit. A certified copy goes one step further, carrying the clerk's authentication for a specific document. Printing a portal page gives you none of that assurance.
| Erath product | Purpose | Source |
|---|---|---|
| Docket | Follow chronology and settings | Portal, re:SearchTX, or Erath clerk |
| Filed paper | Read the document behind an entry | Public image or Erath copy request |
| Certified copy | Obtain clerk authentication | Responsible Erath clerk |
One caution deserves emphasis. An Erath docket line saying an order was signed is only a note about the order, not the order itself. When the actual text matters, name the paper and order that document.
Kinds of Erath Court Records
Erath district files hold felony, civil, and family papers. The Erath County Clerk's criminal records cover county misdemeanors. At the civil counter, expect Justice Court appeals, bond forfeitures, and occupational driver-license applications. Probate files deal with estates and guardianships. Each Erath JP court keeps its own register of civil, eviction, traffic, and fine-only criminal matters.
- Erath case registers and docket sheets
- Erath petitions, complaints, indictments, answers, and motions
- Erath notices, citations, service returns, and continuance papers
- Erath orders, judgments, dispositions, and appeal records
- Public Erath probate papers, subject to lawful restrictions
Not everything in a file is open. Some family, juvenile, expunction, and sealed civil material stays restricted. An Erath docket entry can stay visible even while the document behind it is withheld from view.
Choose an Erath Record Clerk
One blanket request can easily land at the wrong Erath counter. District matters start with Wanda Greer's District Clerk office. It sits at the Donald R. Jones Justice Center, 298 S Graham, Stephenville, 254-965-1486. For county misdemeanor records, call 254-965-1407. Civil and probate records use 254-965-1428. Probate sits at Annex III rather than the Justice Center.
Erath County Clerk
Criminal/civil: 298 S Graham; probate: 222 E College
254-965-1407 or 254-965-1428
Erath JP Precincts 1, 3, and 4 share one line: 254-965-1489. Precinct 2 uses 254-445-2766. Whenever you call, give the cause number and the court's name.
Erath Court Records: What They Contain
An Erath case file links each docket label to the paper filed under it. Labels differ from court to court and case type to case type. The online register does not promise an image for every filing.
| Cause number | Erath court identifier |
|---|---|
| Case style | Erath caption naming procedural parties |
| Filed papers | Erath pleadings, motions, citations, and returns |
| Settings | Erath dates, notices, resets, and continuances |
| Orders | Erath signed rulings and judgments |
| Docket | Erath chronological event history |
A missing Erath image can mean several things. The request may have hit the wrong court, or the gap may come from historical coverage, indexing, or a restriction. It never proves the paper failed to exist.
Erath Forms Versus Court Copies
The Erath non-law-enforcement form wants contact details, a date range, a description of the record, and a delivery choice. Its ten-business-day notice belongs to that Erath county-record process alone. Case records and judicial administrative records run under court rules and other Texas law instead.
Never route a certified-judgment request through the Sheriff form. That form exists for law-enforcement incident records. Send an Erath case-copy order straight to the clerk who owns the case. Clerks will explain procedure, though they cannot hand out legal advice.
Erath County Clerk Fee Caveat
The Erath County Clerk PDF spells out its charges. Noncertified pages run $1 each. Certified papers cost $5 plus $1 per page. A search without a cause number costs $5. An electronic document runs $1 through ten pages, then ten cents per page above ten. One catch: the official PDF is titled Land Record Fees. Confirm an Erath line covers your court file before relying on it.
The Erath District Clerk posts a separate fee PDF. It does not clearly state copy charges. Ask that office for its current amount. County Clerk figures should never be transferred to the District Clerk without confirmation.
Erath Probate Court Records
Probate work in Erath is based at Annex III, 222 E College. The Erath County Clerk handles the estates and guardianships there. That includes citations, letters, notices, reports, and accounts. Keep this separate from the civil counter at the Justice Center.
Open-court probate steps do not open every page of a file. Medical, financial, or minor-related details may stay protected. Ask for the named public paper, and let the clerk apply the governing rule.
Erath Copy Fees and Certification
A plain Erath copy just reproduces an available page. A certified Erath copy adds the clerk's authentication. Say which form you need before the clerk calculates cost. For an appeal, confirm your target. Do you want the full Erath clerk record or a single judgment?
A mailed Erath request should carry the cause number, caption, exact paper, certification choice, return address, and a contact method. Check the live Erath amount and accepted payment method before sending any funds.
Access Rules for Erath Court Records
Texas Rule 12 covers judicial records that sit outside court case records. The Texas Public Information Act treats the judiciary as its own framework. For restricted case material, other rules apply: Rule 76a seals civil files, Family Code Chapter 58 handles juvenile records, and Code of Criminal Procedure Chapter 55A governs expunction.
Erath access rule: A missing result can reflect an incorrect Erath custodian, filter, historical limit, indexing delay, or legal restriction. Confirm status with the originating Erath clerk.
A blank result does not mean an Erath record was sealed or destroyed. Before ordering any document, run the cause through Erath docket search routes and confirm it exists.
Category matters too. An Erath judicial administrative record is one thing. An Erath filed case paper is another. An Erath county administrative record is a third. Name the court, the approximate date, the format you want, and the exact item in any request. Rule 12 gives a process for judicial records beyond case records. Government Code Chapter 552 states Texas's broad access policy but leaves judiciary access to court rules, other law, and common law. That is why the general Erath open-records form cannot promise a certified judgment or a full case file.
Restricted treatment has several sources. Rule 76a sets the civil sealing process. Texas Family Code Chapter 58 governs juvenile access, sealing, and destruction. Family and child-protection records may hide public details. Deferred adjudication is not automatically confidential. Article 42A.106 and related law control that clerk record. Expunction under Chapter 55A is a separate statutory process, and its order gets confidential handling. No rule lets a searcher conclude, from an empty portal screen, that an Erath case was erased, sealed, or never filed.
When an Erath search returns nothing, recheck the court tier and custodian. Confirm the spelling, cause number, date range, and case type. Older Erath material may not sit in the current electronic layer. A document may await indexing or exist only through the clerk. Ask the Erath office whether a public docket exists. Ask whether the image is available, and whether a plain or certified copy can be issued. That fallback protects accuracy and sends the request where it can be answered.
Before paying, repeat the document name, page format, certification choice, and delivery method to the Erath office. The clerk can then tell a simple docket printout from a filed order. The clerk can also tell a certified judgment from a clerk record prepared for appeal.
The office split also affects appeal papers. County Clerk material lists a clerk record for appeal by the page, while a single judgment is a narrower product. State whether the receiving court needs the complete clerk record, one certified order, or a plain reference copy. That distinction helps staff find the right fee line and prevents an incomplete order.
Search coverage has limits. Odyssey and re:SearchTX can overlap. The District Clerk runs an Odyssey/Tyler system with statewide integration, yet the two interfaces need not show identical dates, case types, or document images. A public register can identify a filing without offering its scan. Historical material may require staff retrieval. Keep the cause number, court, filing date, and document title together, then ask the responsible division what public format exists.
Leave out protected personal data a request does not need. A cause number and case style usually beat a broad narrative. Juvenile and family confidentiality, protected identifiers, and sealing orders can limit what staff release. The clerk applies those limits and can describe the process, but cannot interpret a record or advise how to use it.
Electronic access and filing are separate tasks. eFileTexas is the ordinary filing path for applicable civil and family papers. Odyssey and re:SearchTX are retrieval paths. Finding a public docket does not authorize a filing through the search screen. Uploading a paper through e-filing does not guarantee immediate public display. Parties should track the filing receipt and court rules. Public researchers should rely on the clerk for the official file status.
